Filing by Electronic Means

As part of the New York State Courts Electronic Filing System (NYSCEF), certain claims in the Court of Claims may be filed electronically at the NYSCEF web page, subject to the following limitations:

• Only tort claims (claims seeking damages for personal injury or property damage) against the State of New York that accrued in the Court's Albany District -- claims accruing in the following counties: Albany, Essex, Rensselaer, Ulster, Clinton, Franklin, Saratoga, Warren, Columbia, Greene, Schenectady or Washington -- may be filed electronically.
• All papers must be in Adobe .pdf format to be filed electronically.
• In order to file a document electronically, as an attorney or a self-represented (pro se) litigant, it is necessary to register as a filing user on the NYSCEF page.
• When you file a claim electronically, it will be necessary to pay the $50.00 filing fee via credit card, or in person at the Clerk’s office.
• If you file a claim, or any subsequent document, via NYSCEF, DO NOT send courtesy copies to the clerk's office or to judge's chambers unless so directed by the Judge.
• Section 11(a) of the Court of Claims Act provides: "a. (i) The claim shall be filed with the clerk of the court; and, except in the case of a claim for the appropriation by the state of lands, a copy shall be served upon the attorney general within the times hereinbefore provided for filing with the clerk of the court either personally or by certified mail, return receipt requested, or, where authorized by rule of the chief administrator of the courts and upon consent of the attorney general, by facsimile transmission or electronic means, as defined in subdivision (f) of rule twenty-one hundred three of the civil practice law and rules, in such manner as may be provided by rule of court." In any case, an affidavit of service must be filed, electronically, with the court.
• Information and instructions on how to serve the Attorney General electronically may be found at this site.
• You must serve and file, with the claim, a Court Notice Regarding Availability of Electronic Filing. Complete the form and print it out (you will not yet know the claim number) and then serve and file it.
• If you have a pending tort claim in the Albany District and you wish to have that claim be subject to NYSCEF, complete the Court Notice Regarding Availability of Electronic Filing form, serve it on all other parties and file it with the court.
• Use the Consent to E-Filing form.
